1. Introduction

Welcome to Roasters Map, a platform operated by Roasters Map, USA (“Roasters Map,” “we,” “our,” or “us”). These Seller Terms and Conditions (“Agreement”) govern the relationship between Roasters Map and individuals or businesses (“Sellers,” “you,” or “your”) that register to list and sell products and services on our platform.

By registering as a Seller and listing products or services on Roasters Map, you agree to comply with this Agreement. If you do not agree, you must refrain from using the platform as a Seller.

2. Definitions

For the purposes of this Agreement, the following terms have the meanings assigned to them:

•Seller: Any individual or business entity that registers to list and sell products or services on Roasters Map.

•Buyer: Any user of Roasters Map who purchases a product or service from a Seller.

•Commission: The percentage of the sale price deducted by Roasters Map before disbursing payouts to the Seller.

•Payouts: Payments made by Roasters Map to Sellers for completed transactions after deducting applicable commissions.

•Product: Any physical goods related to coffee that a Seller lists for sale on Roasters Map.

•Service: Any coffee-related service, such as barista training or equipment maintenance, offered by Sellers on Roasters Map.

•Dispute: Any disagreement between a Buyer and a Seller regarding a transaction, which Roasters Map may mediate.

•Prohibited Items: Any items or services that are not coffee-related or that violate applicable laws, platform policies, or ethical standards.

•Return and Refund Policy: The policy set by each Seller regarding how returns and refunds are handled for their products or services.

3. Seller Eligibility & Account Registration

•You must be at least 18 years old and legally capable of entering into binding contracts.

•Businesses must provide valid business information, including a registered business name, tax identification number (if applicable), and accurate contact details.

•Sellers must provide bank account details to receive payouts.

•Roasters Map reserves the right to approve, suspend, or terminate any Seller’s account at its sole discretion.

4. Permitted and Prohibited Products and Services

4.1 Permitted Listings

Sellers may only list products and services directly related to coffee, including but not limited to:

•Coffee beans (whole or ground)

•Coffee equipment (grinders, brewers, espresso machines, accessories, etc.)

•Barista training, workshops, and related services

•Coffee roasting services

•Merchandise related to coffee brands or businesses

4.2 Prohibited Listings

Sellers may not list:

•Non-coffee-related products or services

•Alcoholic beverages or tobacco products

•Drugs, controlled substances, or supplements

•Weapons, explosives, or hazardous materials

•Counterfeit or misrepresented products

•Items that violate intellectual property laws or any applicable local, national, or international laws

Roasters Map reserves the right to remove any prohibited listings and may take action against Sellers who violate these restrictions.

5. Seller Obligations

By using Roasters Map as a Seller, you agree to:

•Provide accurate and complete product or service descriptions, including pricing, images, and specifications.

•Ensure the quality, legality, and safety of the listed products or services.

•Comply with all applicable laws and regulations governing the sale of coffee-related products and services.

•Respond promptly to customer inquiries and provide professional customer service.

•Manage order fulfillment, including shipping and delivery, for physical goods.

•Clearly communicate your return and refund policy to Buyers.

•Resolve disputes in good faith and cooperate with Roasters Map’s mediation process if necessary.

6. Fees, Commissions, and Payouts

6.1 Commission Fees

•Roasters Map charges a commission on each sale, ranging from 5% to 15%, depending on the type of product or service.

•The applicable commission fee will be deducted from the total sale price before disbursing payouts to you.

6.2 Payouts and Payment Schedule

•Payouts for completed sales will be processed after 14 days from the date of order completion.

•Sellers must provide valid bank account details to receive payouts.

•Roasters Map is not responsible for payout delays caused by banking issues, incorrect Seller-provided information, or ongoing disputes.

7. Shipping, Returns, and Refunds

7.1 Shipping Responsibility

•Sellers are solely responsible for shipping products to Buyers.

•You must provide accurate shipping estimates, tracking information, and timely updates to Buyers.

•Roasters Map does not handle storage, packaging, or shipping logistics.

7.2 Returns and Refunds

•You must set your own return and refund policy and display it clearly on your listings.

•If a Buyer requests a return or refund, you are responsible for handling it in accordance with your policy.

•Roasters Map may mediate disputes if you and a Buyer cannot reach an agreement.

8. Dispute Resolution

•In the event of a dispute between a Seller and a Buyer, both parties are expected to resolve the matter in good faith.

•If no resolution is reached, Roasters Map may act as a mediator; however, we do not guarantee an outcome favorable to either party.

•Roasters Map reserves the right to withhold payouts if a dispute remains unresolved.

9. Intellectual Property & Content Usage

•Sellers retain ownership of their brand names, logos, product images, and other content.

•By listing on our platform, you grant Roasters Map a non-exclusive, royalty-free license to use such materials for promotional purposes.

•Sellers must ensure that any content they upload does not infringe on third-party intellectual property rights.

•Roasters Map reserves the right to remove any content that violates these terms or applicable laws.

10. Account Suspension & Termination

•Roasters Map may suspend or terminate your Seller account if:

•You violate these terms or engage in fraudulent activity.

•You fail to fulfill orders or provide adequate customer service.

•You list prohibited products or services.

•A dispute with a Buyer remains unresolved for an extended period.

•You may request account closure by contacting Roasters Map at [email protected].

11. Legal Compliance and Taxes

•Sellers are responsible for complying with all applicable tax laws, including the collection and remittance of taxes as required by your jurisdiction.

•Roasters Map is not responsible for your tax obligations or for tax reporting on your behalf.

12. Limitation of Liability

•Roasters Map provides a platform for Sellers but does not guarantee sales, visibility, or revenue.

•Roasters Map is not liable for any damages, losses, or claims arising from your business activities, product/service quality, or interactions with Buyers.

13. Indemnification

•You agree to indemnify and hold harmless Roasters Map, its affiliates, and employees from any claims, damages, or liabilities arising from:

•Violations of this Agreement.

•Misrepresented, defective, or non-compliant products or services.

•Disputes with Buyers.

•Any legal or tax obligations incurred due to your business activities on the platform.

14. Modifications to the Agreement

•Roasters Map reserves the right to update these Seller Terms and Conditions at any time.

•We will notify you of any material changes via email or by posting a notice on the platform.

•Continued use of Roasters Map as a Seller constitutes acceptance of the updated terms.

15. Governing Law & Dispute Resolution

•These terms shall be governed by the laws of the State of Georgia, United States.

•Any disputes arising under these terms shall be exclusively resolved in the courts of Fulton County, Atlanta, GA.

•By using the platform, you waive any right to a jury trial or class-action lawsuit related to disputes with Roasters Map.
